Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the ClaimHero website and services at claimhero.ca (the "Service"), operated by ClaimHero ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What ClaimHero is — and is not

ClaimHero is record-keeping software. It helps you log and organize business expenses by CRA T2125 category and export summaries of the data you enter.

ClaimHero does not provide tax, accounting, legal, or financial advice. Category names, line numbers, notes (such as deductibility percentages), blog articles, emails, and exports are provided for general information only. They may be incomplete, may not reflect the most current CRA rules, and may not apply to your situation. You are solely responsible for the accuracy and completeness of the information you enter, for how you categorize your expenses, and for the contents of any tax return you file. Consult a qualified professional (such as a CPA) for advice about your specific circumstances.

We are not affiliated with, and the Service is not endorsed by, the Canada Revenue Agency (CRA).

3. Your account

You must provide a valid email address and keep your password confidential. You are responsible for all activity under your account. You must be at least the age of majority in your province or territory to use the Service. Notify us at hello@claimhero.ca if you suspect unauthorized use of your account.

4. Plans, billing, and cancellation

  • The Free plan includes up to 50 expense entries per tax year and the features described on our pricing page.
  • The Pro plan costs $4.99 CAD per month (plus applicable taxes) and renews automatically each month until cancelled. Payments are processed by Stripe; we do not store your card number.
  • You can cancel at any time from your dashboard (Manage billing). Cancellation takes effect at the end of the current billing period; you keep Pro features until then. Except where required by law, payments already made are non-refundable — if you believe you were charged in error, contact us and we will review it.
  • Prices and plan features may change; we will give you reasonable advance notice of price changes, and they will apply from your next billing period.
  • One-time services (such as the expense cleanup service) are described at the point of purchase and are delivered as data-organization assistance only — they are subject to Section 2 (no tax advice) like the rest of the Service.

5. Your data

You own the expense records and other content you enter. You grant us a limited licence to host, process, and display that content solely to operate and improve the Service. We handle personal information as described in our Privacy Policy. You can export your data (Pro) and delete your account at any time from the dashboard, which deletes your stored expense data.

6. Acceptable use

You agree not to misuse the Service — including attempting to access other users' data, probing or disrupting the Service, scraping at scale, reselling the Service, using it to send spam, or using it for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost — keep your own copies of source documents and receipts, which the CRA requires you to retain regardless of your use of the Service.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages — including lost profits, lost data, penalties, interest, or reassessments arising from your tax filings — even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us in the twelve (12) months before the claim arose and (b) fifty Canadian dollars ($50 CAD). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing in these Terms limits rights that cannot be waived under applicable consumer protection law.

9. Indemnity

You will indemnify us against claims arising from your violation of these Terms or your unlawful use of the Service.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate the Service or your account for material breach of these Terms, and may discontinue the Service with reasonable advance notice, during which you can export your data.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the site or by email, and the "Last updated" date above will change. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-law rules, and the courts of that province have exclusive jurisdiction — except where the consumer protection law of your own province or territory grants you rights or venue that cannot be contracted out of, in which case those rights prevail.
